The various features and content provided by us, whether free or paid, are intended for general information and educational purposes only, and do not constitute any legal or other professional advice on any subject matter, or any type of diagnosis of any health, mental condition, or healthcare recommendation.

Any assessment on our platform is self-administered, and the resulting content is generated based on your responses. What you do based on the resulting content is a matter for you to decide and should never be dictated by the content itself.

Accordingly, Connected assumes no liability or responsibility whatsoever in respect of any reliance by you on the assessment(s) and resulting content.

1. General Terms

1.1 The terms and conditions set out in this Terms of Use, including the Privacy Policy (collectively, “Terms”), apply to your access to, and use of, any website, mobile applications, and other products and services (collectively, the "Services") provided by Connected Media Pte. Ltd. (“Connected”). By using our Services, you agree to these terms. If you do not agree to these terms, please do not use the Services.

1.2 The Terms are applicable to all users of the Services and constitute a legally binding contract between you and Connected. By using the Services, you confirm that you have read, understood, and agreed to the Terms. The access to or use of certain areas or features of the Services may be subject to separate policies, standards, or guidelines, or may require you to accept additional terms and conditions.

1.3 Where you download any application from a third party digital distribution platform such as Apple iTunes or Google Play, the terms of such platform regarding the checkout process apply in addition to these Terms and, to the extent they govern the technical process of completing purchases and downloads, prevail in the event of any conflict.

1.4 Connected reserves the right, at its sole discretion, to amend any parts of the Terms any time. You should periodically visit this page to review the current Terms so that you are aware of any revision. In the event of any changes to the Terms, Connected will either notify you via e-mail to the email address registered with Connected or post the changes on this page and change the “Last Updated” date at the top of this page as the effective date of change. However, any changes will not apply retrospectively. Your continued use of the Services after any such changes constitutes acceptance of the latest Terms.

2. Definitions and Interpretation

The following words and expressions have the following meanings unless inconsistent with the context or stated otherwise:

“Assessment Results” means the Results of the Personality Assessment generated by the Assessment Tool.

“Assessment Tool” means the Proprietary Personality Profiling Software.

“Connected Technology” means Connected’s proprietary technology underlying the Services, including internet operations design, content, software tools, hardware designs, algorithms, software, source codes, user interface designs, architecture, know-how, trade secrets, and any related intellectual property rights throughout the world (whether owned by Connected or its licensors) in connection with the Services, and also including any derivatives, improvements, enhancements, or extensions of the technology conceived, or developed by Connected from time to time.

“Content” means any data, text, software, music, sound, photographs, graphics, videos, messages or other materials, including but without limitation to, company logos, trademarks, copyrighted materials and Third-Party Resources, displayed, published or made available through the Services, whether by Connected or you.

“Intellectual Property Rights” means all intellectual property rights (whether registered or not) including, but not limited to, copyright (including copyright in computer software), patents, logos, trademarks or business names, design rights, database rights, know-how, trade secrets, and rights of confidence in connection with the Site, Services and/or Content.

“Parties” means collectively Connected and you, and a “Party” means either of them.

“Payment Method” means your current and valid method of payment that is accepted or acceptable by Connected as may be varied or updated from time to time.

“Personal Data” means data that may enable Connected to identify users personally, including data about a person who can be identified (i) from that data, or (ii) from that data and other information to which Connected has or are likely to have access.

“User’s Content” means any data, text, software, music, sound, photographs, graphics, videos, messages or other materials, including, but without limitation to, company logos, trademarks and copyrighted materials, that you post, upload, transmit or otherwise make available through the Services.

3. Eligibility To Use

You must be at least 18 years old and able to enter into legally binding contracts to access and use the Services and/or register an Account (defined below) as a User. By accessing or using the Services, you represent and warrant that you are 18 or older and have the legal capacity and authority to enter into a contract. You may allow your children below the age of 18 to answer the personality assessment about themselves with your knowledge and permission while logged into your account.

4. Account Registration

4.1 You are required to register through the Site and maintain an account with Connected (“Account”) in order to use the Services, whether free or paid. If you choose to register for an Account, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the relevant registration form or, when required, to verify the same before Account activation.

By registering an Account, you authorise Connected to collect, store, retain, process, and use Personal Data provided to Connected in accordance with the Personal Data Protection & Privacy Policy. It is important for you to provide and maintain accurate, complete, and up-to-date personal data (including having a valid or current Payment Method) to enable Connected to properly perform the Services. If you do not, it may result in you not being able to access and use the Services.

In any event, Connected reserves the right, at its sole discretion, to approve or refuse registration of an Account. Connected may also enable registration for an account directly or through your existing account with certain third-party social networking services such as Facebook or Google (each an “SNS Account”). If you choose the SNS Account option, we will create your Account by extracting from your SNS Account relevant personal information such as your name and email address and other personal information that your privacy settings on the SNS Account allows.

You agree that you will not disclose or share your password with anyone. You are responsible for the activities that occur under your Account, whether you are aware of them or not.

4.2 You may not assign or otherwise transfer your Accounts to any party without the prior written authorisation by Connected.

4.3 You acknowledge that Connected may establish general practices and limits concerning use of the Site and agree that Connected has no responsibility or liability for the deletion or failure to store any data or other content maintained or transmitted by the Site. You acknowledge that Connected reserves the right to terminate any Account that is inactive for an extended period of time. You further acknowledge that Connected reserves the right to change these general practices and limits at any time, at its sole discretion, with or without notice.

4.4 By registering an Account, you agree to receive informative, promotional, or marketing emails or communications in connection with the Services, but you may opt-out from receiving such communications by clicking the “Unsubscribe” link at the bottom of the e-mail or exercise your rights as owner of your Personal Data under the Privacy & Cookies Policy.

4.5 Connected may in its absolute discretion immediately suspend, discontinue, or terminate your access to and/or use of the Site, Services, and/or your Account under the Terms in the event of any actual or suspected breach of any provisions under the Terms, with or without notice at any time without incurring any liability whatsoever to you or any third party. In this instance, Connected reserves the right to remove and discard data in and content of your Account. Any suspected fraudulent, abusive, or illegal activity that may be grounds for such suspension, discontinuance, or termination may be referred to the appropriate law enforcement authorities.

5. Payments, taxes and refunds

5.1 You can access certain features and Content on our Services for free (“Free Services”), and unlock and access other features and Content for a charge (“Paid Services”). Connected reserves the right to eliminate or modify any or all of the features and Content at any time without any prior notice to you.

Connected will charge your selected payment method for any Paid Services, including any applicable taxes.

Connected may from time to time change the price for Paid Services, and will communicate any price changes to you in advance on reasonable notice, with the date after which purchases will be charged at the new price.

5.2 If technical problems prevent or unreasonably delay delivery of the Paid Services, your exclusive and sole remedy is either replacement of the Paid Services or refund of the price paid, as determined by Connected.

5.3 Notwithstanding these Terms, the laws in your country may apply to the purchase of virtual goods and services supplied by Connected to you and you may have rights or remedies as set out in such laws that apply in addition to, or, to the extent that they are inconsistent, instead of, the rights or remedies set out in these Terms.

6. Promotional Offers, Discounts, Promo Codes, etc

6.1 From time to time, Connected may run promotions, contests, surveys, privileges, and other programmes (collectively, “Promotions”), subject to additional terms and conditions which can be found on the Site and are hereby incorporated by reference into the Terms. Promotions are only valid for such time periods as Connected may determine at its sole discretion.

6.2 The following terms shall apply to the use of credits, vouchers, coupons, and codes (collectively, “Promo Codes”):

6.2.1 Promo Codes may only be used pursuant to the specific terms that Connected establishes for such Promo Codes, and you must enter the relevant Promo Code into the relevant field prior to completing an order.

6.2.2 Promo Codes are not resale-able, transferable, exchangeable, convertible or redeemable for cash.

6.2.3 Promo Codes may not be combined or accumulated with other offers or promo codes.

6.2.4 Unless otherwise specified solely at Connected’s discretion, no reproduction, alteration, adaptation, tampering, distribution, publication, broadcast, or other communication or dissemination of Promo Codes is allowed. Promo Codes are non-replaceable if lost, stolen, destroyed, duplicated, tampered with, or otherwise misappropriated or fraudulently used. Connected reserves the right to verify the validity of any Promo Code and to declare null and void any Promo Code which in its opinion has been stolen, duplicated, tampered with, or which is suspected to have been misappropriated or fraudulently obtained or used.

6.2.5 Connected reserves the right to withhold, deduct, or remove credits or other features or benefits obtained through the use of a Promo Code in the event that Connected determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal, or in violation of the applicable terms and conditions of the Promo Code or the Terms.

6.3 Where any free gift is offered as part of a Promotion, the free gift is offered on a “first come first served” and while stocks last basis. No cash will be offered in lieu of the gift.

6.4 Connected’s decision on all matters relating to Promotions and Promo Codes is final and binding.

6.5 Connected reserves the right to change, suspend, cancel, and/or waive any Promotion or Promo Code and its applicable terms and conditions thereof at any time and from time to time at its sole discretion without notice to you and liability to Connected.

7. Right of Use, Obligations and Restrictions

7.1 Upon purchase, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Assessment Tool and other contents or benefits in accordance with and subject to the Terms. Any rights not expressly granted herein are reserved by Connected.

7.2 You may only use the Services in compliance with applicable laws and for legitimate purposes. You agree to comply with the Terms, all local rules, and laws regarding the use of the Services, including your online conduct, which are applicable in their jurisdictions.

7.3 In using the Site, Services and/or Content, you must not:

7.3.1 use them for any purpose that is improper or unlawful in violation of any applicable local, state, national, or international law, or any regulations having the force of law, or the Terms.

7.3.2 use them in any manner that could damage, disable, or impair Connected’s server, or interfere with other Users’ access or use of the Site, and security related feature of the Site.

7.3.3 disassemble, reverse engineer, decompile, modify, or otherwise create derivative works based on Connected Technology, any software, applications, updates, or hardware contained in or available via the Site.

7.3.4 do anything or cause an action to be done resulting in the infringement or violation of Connected’s Intellectual Property Rights.

7.3.5 attempt to gain unauthorised access through means of hacking, mining or other interference.

7.3.6 solicit personal information from anyone under the age of 18.

7.3.7 harvest or collect email addresses or other contact information of other Users by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.

7.3.8 interfere with or disrupt the Site, or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site, or circumvent any technology used to protect the Site.

7.3.9 obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Services

7.3.10 remove, alter, or replace any notices of authorship, trademarks, business names, logos, or other designations of origin on the Site, or pass off or attempt to pass off the Services as the product of anyone other than Connected.

7.4 Connected reserves the right to investigate and take appropriate legal action against anyone who, in its opinion, violates the above provisions, including but not limited to, suspending or terminating the Account of such violators and reporting them to the law enforcement authorities.

7.5 You are solely responsible for your own hardware, internet connection or telecommunication charges incurred for accessing, connecting to or using the Site.

7.6 You are solely responsible for any and all additional taxes (such as VAT) incurred in your respective geographical area unless otherwise explicitly specified during purchase.

8. User’s (Your) Content

8.1 To the extent where the Site allows you to post, upload, transmit or otherwise make available any of Your Content, you consent, represent and warrant that: (i) you are either the sole and exclusive owner of Your Content or have all rights, licenses, consents, and releases necessary for use of the Your Content on the Site; and (ii) neither Your Content nor your submission, uploading, publishing or otherwise making available of Your Content nor Connected’s use of Your Content as permitted herein will infringe, misappropriate, or violate a third party’s intellectual property or proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation. You further agree that:

8.1.1 You will not share or transmit any material or content that (i) is unlawful, offensive, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another‘s privacy, hateful racially, ethnically, or otherwise objectionable; (ii) you do not have a right to transmit under any law or under contractual or fiduciary relationships; (iii) poses or creates a privacy or security risk to any person; (iv) infringes any intellectual property or other proprietary rights of any party; (v) constitutes unsolicited or unauthorised advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation; (vi) contains malicious content, software viruses, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; or (vii) is illegal, or intended to promote or commit an illegal act of any kind; or (viii) in Connected’s opinion, is objectionable or which restricts or inhibits any other person from using or enjoying the Services, or which may expose Connected or other Users to any harm or liability, or disrepute of any type.

8.1.2 You will not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

8.1.3 Connected is under no obligation to store, retain, publish, or make available any of Your Content and you shall be responsible for creating backups of any of Your Content if necessary.

8.1.4 under no circumstances shall Connected be liable in any way for any Your Content, including, but not limited to, any errors or omissions in Your Content, or any loss or damage of any kind incurred in connection with the use of or exposure Your Content made available via the Site.[do1]

8.2 Connected reserves the right to moderate any of Your Content and remove any of Your Content as it deems appropriate at its sole discretion. Connected shall have the right to appoint any person as moderator on behalf of Connected. The right of Connected to moderate Your Content does not in any way mean or imply that any Your Content made available on or through the Site is endorsed by Connected.

8.3 All data that you input to the system underlying the Site, including Personal Data of your children, shall belong to you or their respective owners. However, Connected shall be entitled to prepare analysis and/or statistics based on your data input into the system underlying the Site, provided that such analysis and/or statistics make no specific reference to any Personal Data. Such analysis and/or statistics shall be the property of Connected and you shall have no claim whatsoever to such analysis and/or statistics.

9. Updates, Modifications, and Availability

9.1 Connected may modify or upgrade the features and functionality of the Services from time to time, and reserve the right to make upgrades, updates, modifications, and changes. You understand that such upgrades or changes may result in interruption, modification, failure, delay, or discontinuation of the Services or any function or feature thereof. In this regard, you acknowledge and agree that Connected assumes no liability, responsibility, or obligation for any such interruption, modification, failure, delay, or discontinuation associated with the Services. However, Connected will make reasonable efforts to minimise interruptions, failure, or delay of the Services, and will make reasonable efforts to inform you of any scheduled maintenance or material changes which may affect the use of the Services.

9.2 Notwithstanding anything contained in the Terms, Connected reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof). You agree that Connected shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Services provided.

10. Intellectual Property

10.1 The Site, Content, and Connected’s Technology underlying the Services are the property of Connected and/or its licensors, and are protected by copyright and/or other intellectual property rights. Except where expressly authorised by Connected, you agree to not modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Site, Services and/or Content, in whole or in part. The word “Connected” and associated logo are the trademarks, trade names and/or service marks of Connected, and you agree not to display or use in any manner such names and/or marks without Connected’s prior written authorisation. In using the Services, you shall not engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods. You further acknowledge that you have no right to access any aspect of the Site in source-code form, and agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in Connected Technology. Any uses of the Site, Services, and/or Content not expressly permitted herein are prohibited, and any rights thereof not expressly granted herein are reserved by Connected.

10.2 By using the Services, you will not acquire any right, title, or interest into the Intellectual Property Rights except for the limited right to use the Services granted to you pursuant to the Terms. Nothing in the Terms or the Services should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of Connected’s trade or service marks displayed on the Site without Connected’s prior written permission in each instance. All goodwill generated from the use of the Site, Services, and/or Content will inure to Connected’s exclusive benefit.

10.3 To the extent where you provide Connected with any suggestions, comments, improvements, ideas or other feedback (“Feedback”), you hereby assign ownership of all intellectual property rights subsisting in that Feedback to Connected and acknowledge that Connected can use and share such Feedback for any purpose in its sole discretion.

10.4 Other company, product, and service names and logos used and displayed via the Site may be trademarks or service marks of their respective owners who may or may not be endorsed by, affiliated with, or connected to Connected.

11. Third-Party Resources

11.1 The Site may contain links to third parties’ websites, products, services, information, advertisement, or other materials (“Third-Party Resources”) that are not owned or controlled by Connected, or the Services may be accessible through Third-Party Resources. Links to Third-Party Resources do not constitute an endorsement or recommendation by Connected of such Third-Party Resources.

11.2 When you access Third-Party Resources, you do so at their own risk. You hereby represent and warrant that you have read and agree to be bound by all applicable policies of any Third-Party Resources relating to the use of their services and act in accordance with those policies, in addition to your obligations under the Terms.

11.3 Connected has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any Third-Party Resources. In addition, Connected will not and cannot monitor, verify, censor, or edit the content of any Third-Party Resources. You expressly relieve and hold Connected harmless from any and all liability arising from the use of any Third-Party Resources.

12. Disclaimers

12.1 The Terms set out the full extent of Connected’s obligations and liabilities with respect to the Site and Services.

12.2 The Assessment Tool, Assessment Results, and various materials provided by Connected on or through the Site, whether free or paid, are provided for general information or educational purposes only, and do not constitute any legal or other professional advice on any subject matter, or any type of diagnosis of any health, mental condition, or healthcare recommendation. The Assessment Tool is a self-administered assessment, and the Assessment Results are generated based on information input by you. Assessment Results aim to enhance your self-awareness of your own experiences and provide you an opportunity to reflect on them. What you choose to do or ‘should’ choose to do with the results of any given test is a matter for you to decide and should not be dictated by the test itself. Accordingly, Connected assumes no liability or responsibility whatsoever in respect of any reliance by you on the Assessment Tool and/or Assessment Results.

12.3 Connected provides the site and services on an "as is" and "as available" basis. You agree that use of the services is at your sole risk. Connected expressly disclaims all warranties of any kind, including, but not limited to, (i) the implied warranties of merchantability, (ii) fitness for a particular purpose and non-infringement, (iii) security, reliability, performance, and accuracy of the service, (iv) that the services will be continuous, uninterrupted and/or error-free, (v) the accuracy or truthfulness of any content or user’s content, and (vi) the truth or accuracy of assessment tool, assessment results, performance indicators, or other content made available via the site. No advice or information, whether oral or written, obtained from connected or through the site, will create any warranty not expressly made herein.

12.4 Connected has no responsibility whatsoever for any arrangements that you make with any third party as a result of using the Services.

12.5 You may see advertising material submitted by third parties on the Site. Each individual advertiser is solely responsible for the content of its advertising material and Connected accepts no responsibility for the content of such advertising material, including, without limitation, any error, omission, or inaccuracy therein.

12.6 If you are dissatisfied with the Services, or do not agree with any part of the Terms, please discontinue use of the Services.

13. Exclusion and Limitation of Liability

13.1 To the fullest extent permitted by law, in no event shall Connected be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages, or any damages or losses of any kind in any manner in connection with or arising out of these terms or the site, services, or content, regardless of the form of action or the basis of the claim or whether or not connected has been advised of the possibility of such damages, including, without limitation, damages for loss of profits or opportunity, business interruption, or any other commercial damages or losses. In the event that applicable law does not allow the exclusion of warranties stated herein or the limitation of liability stated herein, then you expressly agree that in no event will Connected’s liability for any claim or damages hereunder exceed the module price or subscription fee (as the case may be) paid by you to Connected in respect of the services that are the subject of your claim.

13.2 Nothing in the Terms shall limit or exclude (i) any other liability that cannot be excluded by law, or (ii) your statutory rights.

14. Indemnity and Release

You hereby agree to indemnify Connected, including its directors, officers, employees, or agents (“Indemnified Parties”), and keep the Indemnified Parties harmless from and against any claims, actions, suits, proceedings, damages, and/or liabilities whatsoever made against the Indemnified Parties arising from the use of the Site, Services, Content, and/or performance of Your duties and obligations under the Terms save where such claims, actions, suits, proceedings, damages, and/or liabilities arise from the gross negligence, willful misconduct, or breach of these Terms by the Indemnified Parties.

15. Term, Suspension and Termination

15.1 The agreement between Connected and you under the Terms shall take effect upon the earlier of (a) your commencement of the use of the Services, or (b) registration of an Account, and will remain in full force and effect for as long as you use the Services. Either party may terminate use of the Services with or without cause at any time with reasonable prior notice.

15.2 Upon termination of the agreement with you pursuant to the Terms, any sum owing or due to Connected shall be immediately payable, and your access rights to the Services and other rights hereunder shall terminate.

15.3 All provisions of the Terms which, by their nature, should survive termination, shall survive termination, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

16. Notice

16.1 All notices, requests, and/or other communications to be given by Connected to you under the Terms may be:

(a) via e-mail to the e-mail address registered with Connected

(b) published on the Site.

16.2 All notices, requests, and/or other communications to be given by you to Connected under the Terms must be communicated to the following address (or to such other address as Connected may give notice to you from time to time) by e-mail to: admin@getconnected.sg

17. Other Terms

17.1 No delay, neglect, or forbearance on the part of a Party in enforcing against the other Party any term or condition of the Terms shall either be or deemed to be a waiver or in any way prejudice any right of that Party under the Terms.

17.2 If any provision of the Terms is prohibited by law or judged by a court to be unlawful, void, or unenforceable, the provision shall, to the extent required, be severed from the Terms and rendered ineffective as far as possible without modifying the remaining provision of the Terms, and shall not in any way affect any other circumstances of or the validity or enforcement of the Terms.

17.3 The Terms and all rights and obligations thereof are not assignable, transferable, or sub-licensable by you without Connected’s prior written consent. Connected may transfer, assign, or delegate the Terms and its rights and obligations thereof without prior notice to or consent by you.

17.4 The Terms are personal to you. A person who is not a party to the Terms shall have no right to enforce any provision of the Terms.

18. Governing Law and Jurisdictions

Irrespective of the country or geographical region you are from, in which you access or use the Services, to the extent permitted by law, the Terms and your use of the Services shall be governed in accordance with the laws of Singapore without regard to choice or conflicts of law principles, and you hereby agree to submit to the exclusive jurisdiction of the courts of Singapore to resolve any claims or disputes which may arise in connection with the Terms.
